What are the laws regarding rape charges in California?

Most of our Fresno readers already know that rape is one of the most serious criminal charges that a person can face in California. But, what some of our readers may not know is that there are certain levels and degrees of criminal charges that a person might commonly refer to as rape. So, what are the laws regarding rape charges in California?

Investigation of sex crimes leads to arrest of Fresno resident

Most Fresno residents probably know their neighbors and feel comfortable where they live. But, many people also know that allegations of child sexual abuse against a local resident can rock a community. One part of Fresno is feeling these effects in the wake of the arrest of a 29-year-old man earlier this month on several sex crimes charges - all felonies - in which the alleged victim was a minor child.

Search warrant requirements under the Fourth Amendment

Most of our readers probably know that searches are a regular part of police practice throughout the country. Residents of Fresno have probably seen news stories about "drug busts" where a SWAT unit raids a person's home and finds drugs or weapons. Still, what many people may not know is that in the vast majority of these types of raids, law enforcement officials have gone through the process of securing a search warrant. Still, in some cases the warrant may not be adequate and can be questioned by a criminal defense attorney.

Raising a reasonable doubt in a criminal trial

Most of our Fresno readers probably know that the standard that a prosecutor has to meet for a case to result in a criminal conviction is "beyond a reasonable doubt." Movies and television shows focused on criminal law and courtroom action have left many of us familiar with this fact. In general, if a defendant can raise the specter of a reasonable doubt that the crime did not occur the way the prosecution says it did, the defendant may be found not guilty.
